Condominium Law
The attorneys in the SSE&C business entity practice area, in consultation with the attorneys in the real estate and litigation practice areas, work together to represent both preexisting and newly organized condominium associations Our services encompass all phases of the practice, from the initial formation of the association to providing counseling to the association for resolution of its everyday legal and business issues. These services include:
- Creating rules and regulations for newly established associations and cooperatives that are converted into condominium associations
- Providing counsel to the governing board of condominium associations relating to enforcement of rules and procedures, interpretation of the governing documents of the association, preparation and revision of existing by laws, Master Deed and other instruments in order to enable proper and judicious governance by the association’s governing body
- Negotiating and drafting contracts on behalf of the associations for various vendors that provide day-to-day maintenance services and vendors that are retained for significant repairs and replacements of facilities
- Advising the governing board of the condominium association with respect to enforcement of the association’s governing documents and its rules and regulations, and instituting and pursuing legal action on the association’s behalf should that become necessary
- Advising the unit owners and the governing board of the association when control passes from the developer to the association and assisting in the negotiations to assure that the developer’s responsibilities and obligations are identified and enforced
SSE&C attorneys regularly provide legal and practical counseling to condominium associations and their property management firms.
