Student Rights
School administrators must be ever cognizant of the various legal protections which school pupils enjoy. SSE&C is there to assist administrators and boards of education with the panoply of actions which may implicate pupil rights, including:
- Exercise of the First Amendment right of freedom of expression, verbal and written
- Exercise of the First Amendment right of freedom of religion
- Student discipline, including assistance with disciplinary hearings and board-level suspension or expulsion hearings
- Substance and alcohol abuse related issues and drug testing
- Rights of disabled students
- Residency disputes
- Student bullying and harassment problems
- Student assaults and violence in the schools
- Internet usage and regulation
For students who are eligible for protection under Section 504 of the Rehabilitation Act of 1973, our services include assistance in identification, preparation of accommodation plans, and defense of claims of discrimination on the basis of disability. For students who are behaviorally involved, we provide legal guidance to assure both disciplinary and remedial actions are legally appropriate. We ensure that notices and hearings at the administrative and board level comport with board policy, state laws, and precedential case law.
